The increasing cases of paper leak have increased the concern of the government. This is also considered to be a major reason for the defeat of BJP on many seats in UP in the Lok Sabha elections. The BJP think tank is also constantly reviewing it. It is believed that the youth were angry due to the continuous paper leaks. Amidst all this, CM Yogi announced to make a new and strict law in cases of paper leak.

Question- 1: Which department will make the law to prevent paper leak and cheating?
answer: First of all, a draft of the law to stop cheating will be prepared. The Justice and Law Department and the Home Department will work on this. The draft will be prepared and placed before the Chief Minister, as both the departments are with CM Yogi.
Question-2: What will be the punishment provisions in the law?
answer: A strict law will be brought in from other states. The provision of punishment will be compared with other states. The department preparing the draft will see what can be the maximum punishment if the charges are proved? The Home Department will see what maximum punishment can be given to the accused under this law in the court.
If the UP government follows the Rajasthan model, a provision of life imprisonment and a fine of Rs 10 crore can be made. Acts like NSA or Gangster Act can be imposed. If these laws come under its purview, then bulldozers can also be run on their properties. The financial loss can be compensated by confiscating the properties.
Question- 4: What is the procedure for bringing a law?
answer: After legal scrutiny to implement the law, this draft can be implemented in two ways.
First method: If the session is going on, it will be presented in the Legislative Assembly and Legislative Council. Where it will be passed by a majority of two-thirds of the members. Then it will be sent to the Governor for approval. As soon as the Governor approves it, it will become a law and will be implemented.
Second method: If the session is not going on, then this law can be implemented by bringing an ordinance. This too will require the consent of the Governor. Within 6 months of the implementation of the ordinance, it will have to be passed by both the houses. If this is not done, then the Chief Minister can extend the ordinance for another 6 months with the consent of the cabinet. The same process will be applicable for the next 6 months as well.
Question- 5: What immediate steps has the government taken to stop paper leak cases?
answer: CM Yogi has said that only government secondary, degree colleges, universities, polytechnics, engineering and medical colleges or well-financed educational institutions with a clean track record should be made centres for selection exams.
The centres will be those where CCTV is available. The examination centres will be in urban areas. While setting up the examination centres, the facilities of women and disabled persons should be kept in mind. If an aided college is made a centre, then the concerned manager should not be involved in the examination arrangements in any way.
Question- 6: What law already exists in UP to prevent paper leak?
answer: The accused of paper leak easily get bail. The reason is the lack of strict laws. In UP, action is taken only under the law made in 1998. There is a provision of one to seven years of punishment and a fine of 10 thousand rupees. In such a situation, the accused have no fear of severe punishment.
Question- 7: What law did the central government make to stop paper leak?
answer: The Centre introduced a bill in the Lok Sabha on February 5 to curb paper leaks or cheating in government recruitment exams. It provides for a minimum of 3 years and maximum of 10 years of jail and a fine of up to Rs 1 crore for those found guilty of cheating in exams. This bill has been passed in the Lok Sabha, now it will be introduced in the Rajya Sabha. After being passed here, it will go to the President. The law will be made after his assent.

Question- 8: What is the law in other states of the country?
answer: Six other states in the country currently have laws similar to UP. Chhattisgarh had similar old anti-cheating laws in 2008, Jharkhand in 2001, Andhra Pradesh and Telangana in 1997, Odisha in 1998 and Maharashtra in 1982.
A year ago, the Public Examination Amendment Act 2023 was implemented in Rajasthan. Under this new law, there is a provision of life imprisonment and a fine of Rs 10 crore for the accused. A rule has also been made to confiscate the property of the accused. To ensure that the culprits in the paper leak case get quick punishment, a separate trial of each accused is being conducted in the court. In Gujarat and Uttarakhand too, the law has been amended and made stricter.
Question- 9: Will strict laws stop rigging?
answerOn this question, former IPS Ram Pratap Singh says- Only making strict laws will not curb such cases. Have the copy mafias become inactive in those states where the laws are stricter than here? I believe that first of all the departments conducting the examination will have to be made strict. Their involvement has come to light in most of the cases of paper leak. For this, some such foolproof plan should be made.
Question 10: What kind of law should be made to stop paper leak cases?
answer: Former UP DGP Vikram Singh says- It is important that the law is strict. Sections like NSA and Gangster Act should be included in the law. Whoever is found to be involved, their properties should be bulldozed and confiscated. They should be sent to jail for a long time. Only then will fear be created and these incidents will be curbed.
