The Lucknow High Court has dismissed the PIL challenging Rahul Gandhi’s citizenship. However, the court has allowed the petitioner to raise the matter before the competent authority under the Citizenship Act.

This order was passed by a division bench of Justice Rajan Roy and Justice Om Prakash Shukla on the petition of S Vignesh Shishir. The petitioner had argued that Rahul Gandhi is a British citizen, hence he is ineligible to contest elections. He cannot hold the post of Lok Sabha member.

The petitioner argued that he has attached many documents in support of his argument. During the hearing, the court asked the petitioner why he has not given detailed information about himself in the petition. Whereas it is mandatory to mention this in a PIL.

On this, the petitioner told the court that he is a resident of Karnataka, a farmer by profession and has been a member of the Bharatiya Janata Party. After a brief hearing in the court, the petitioner requested the court to allow him to withdraw his petition, and also asked the court for permission to allow him to raise the matter before the competent authority under the Citizenship Act. On which the court accepted the petitioner’s request and dismissed his petition.
