lucknow high court news | Order of Lucknow Bench of High Court: Center-State cannot order government to give benefits of schemes on economic basis – Lucknow News



After hearing a PIL, the Lucknow Bench of Allahabad High Court said that it cannot issue such orders to the Central and State governments to give benefits of government schemes to people on the basis of economic status and not on the basis of being SC, ST, OBC or minority.

The court said in its order that this is a policy matter of the central and state government. It is outside the jurisdiction of the court. The court also said that if the petitioner wants, he can present his case with all the documents before the government or MPs and MLAs.

This order was passed by a bench of Justice Rajan Roy and Justice Om Prakash Shukla after hearing a public interest litigation filed by Satya Narayan Shukla and others in the year 2018. Through the petition, the petitioner told the court that giving benefits of government schemes on the basis of caste or religion is a violation of the right to equality under Article 14 of the Constitution.

Opposing the petition, the advocate on behalf of the state government told the court that the government has started many schemes for the people on social, economic and educational basis.

It was said that the Samajwadi Pension Scheme which was earlier run on the basis of caste and religion has been discontinued. At present, the benefits of the schemes are being given on the basis of income. It was said that the benefits of the beneficial schemes being run by the state government at present are not being given on the basis of caste or religion.
