This order has been given by the division bench of Justice Siddharth Verma and Justice RMN Mishra while hearing the petition of Pramod Yadav and others.

Accused of being framed due to political enmity
The petitioner says that she is innocent. A false case has been filed due to political enmity. Therefore, the FIR of 7 November 23 should be cancelled. In the argument, she said that she is a co-accused. The victim is planted. The enemies of the main accused MLA Rameshwar Singh Yadav and Jugendra Singh Yadav have fabricated fake evidence. The victim’s date of birth is recorded as 1 January 1997 in her Aadhaar card and her husband Lakhan Singh’s name is written on it. She also has a child born in November 2016.
Whose name is Nitin Kumar. A second Aadhaar card was made in which the husband’s name was removed and the date of birth was registered as 1 January 2000. The FIR was registered on 7 November 23, 7 years and 10 months after the incident.

The incident is said to have taken place on 29 January 16 at 9.30 am. The presence of the main accused is recorded in the assembly at that time. The distance from Etah to Lucknow is 370 km. It is impossible for the main accused to reach Lucknow after committing the crime. On which the court sought an affidavit from the investigating officer as to how it is known that the main accused MLA was present in Etah. Whereas his name is recorded in the presence register in the assembly.
