Allahabad High Court has sought a reply from the District Magistrate of Gorakhpur on a petition filed regarding non-action in a case of Gangster Act. Also, the stay on oppressive action against petitioner Hemwanti Patel, resident of Deoria, has been extended till the next hearing.

This order has been given by the division bench of Justice VK Birla and Arun Kumar Singh Deswal on the petition of Hemvanti Patel.
A case under Gangster Act is registered against Hemvanti Patel in Chilwatal police station of Gorakhpur. The FIR of this case has been challenged in the petition. Advocate Sunil Chaudhary told the court that three false cases were registered against the petitioner, in which she is on bail. Also, action under Gangster Act against the petitioner is wrong. DM has not prepared the Gangster Chart by holding a joint meeting. The court had sought reply in this matter in the last hearing and had put a stay on the harassment action against the petitioner. Three cases are registered against the petitioner on the charges of registering and helping in filing false cases of rape, POCSO and fraud. The leader of her gang is Vikas Sinha. A warrant was issued for attachment action against the petitioner.
The Additional Government Advocate filed a reply in which nothing was said about the joint meeting. On this, the court has asked the Additional Government Advocate to file all the records and complete information and register in relation to the meeting by DM Gorakhpur.
