According to sources, CM Yogi Adityanath has said that after taking legal advice on the matter, he will file a petition in the Supreme Court. BJP is active in holding by-elections in Milkipur and it is believed that Baba Gorakhnath may approach the Supreme Court to withdraw his petition, so that the by-elections can be announced as soon as possible.

The case assumes significance because sitting MLA Awadhesh Prasad has become an MP and has resigned from the Assembly, leaving the seat vacant and necessitating a by-election.

Gorakhnath Baba, who has already been an MLA from Milkipur, had filed a petition in the High Court regarding the assembly seat in 2022. Recently, he applied in the High Court Lucknow Bench to withdraw the petition, but the date of hearing was fixed as November 2, 2024.

During this time, notice has been issued to all the parties and orders have also been given to publish it in the Gazette. In view of the long judicial process, Gorakhnath Baba immediately left for Delhi after meeting CM Yogi.

Now they are preparing to file a petition in the Supreme Court after taking advice from a senior lawyer. BJP is fully prepared for the by-elections, and the election process can be expedited as soon as the petition is filed in the Supreme Court.
