Allahabad High Court canceled the selection of 169 tainted candidates in the recruitment of 1314 posts of Junior Engineer, Assistant Engineer, Routine Grade Clerk etc. before dividing Uttar Pradesh Jal Nigam into urban and rural. Also, according to the merit of the remaining 163 selected

The court said that these people will be given seniority but they will not get their salary for the period they remain out of appointment.

The court said that only those candidates who appear in the merit list of 479 candidates released by Aptech Limited, who have approached the High Court, will be called for interview. After interviewing 479 candidates included in the selected list, the court has ordered to declare the result within three months and after determining the merit as per the reservation rules, appoint the applicants who have got the cut off.

Those who do not come to the High Court do not benefit

The court said that the candidates who left their claims after being satisfied with the result and did not come to the High Court, will not get any benefit of the selection result. Only the petitioners who come to the High Court will be called for interview. With this, the court has canceled the Jal Nigam’s order of March 2, 2020.

Justice Ajit Kumar has given this order while disposing of the petitions after hearing senior advocates Ashok Khare and RK Ojha on 32 petitions of hundreds of candidates including Samrah Ahmed.

According to the facts of the case, before bifurcation, Jal Nigam had recruited 335 Steno including Clerk, 853 Junior Engineer, 122 Assistant Engineer and four Computer Science/Electronic Communication posts. After the exam result, interview took place and selection result was declared. Reports of some doubtful candidates were sought from CAFSL Hyderabad. In which 169 candidates were found to be fake. He gave interview through fake and illegal means and was selected. After the revised result, 479 candidates were to be called for interview for the post of Junior Engineer but were not called.

It was argued on behalf of the petitioners that the selection result of Junior Engineer recruitment was released on July 1, 2017. The petitioners were declared successful in that. After this he got the appointment. He was deployed in various districts. Meanwhile, a petition was filed in the High Court regarding some questions of the final answer key. The court directed the department to consider the complaints of the petitioners and take a decision. In view of this order, the department canceled the entire selection result and canceled the appointments of the selected applicants. Before doing so, neither any notice was given to the petitioners nor were they given an opportunity to present their case. It was also not explained how the petitioners are responsible for the selection results being corrupted. The petitioners said that they were fired after three years of service after selection.

The court said that the petitioners who are involved in this should be called for interview and after merit, they should be given appointment as per the cut off. But the candidates who did not come to the court and are included in the 479 selected will not be entitled to this benefit.

In a 242-page decision that came almost four years later, the court made it clear that at the time of advertisement and selection, Jal Nigam was an integrated corporation. Therefore, Jal Nigam was responsible for their appointment and the selected candidates were integrated employees of Jal Nigam. The conversion of the erstwhile UP Jal Nigam into UP Jal Nigam (Urban) and (Rural) in the year 2021 will not have any impact on the claims of the petitioners.
