The Tehsil Court has ordered the vacation of the mosque of this village which is about 65-70 years old. The court has accepted that this mosque is built on the land of the pond. Elders who have spent their entire lives in this village say that they have never seen a pond at this place till date. First there was vacant land here, then a mosque was built. Both Hindus and Muslims support this.

The mosque side has filed an appeal in the higher court against the decision of the lower court. On which a long hearing is expected. First understand the whole matter… Rajpur Khampur is a village of Khadar adjacent to the Haryana border in Baghpat district of UP. On October 28, 2024, Assistant Collector/Tehsildar Abhishek Kumar Singh issued a 5-page order. It was written in it that Khasra No. 603, the complainant son Waheed is being evicted for illegally occupying 0.282 hectare out of 0.630 area of ​​the pond and building a mosque. A fine of Rs 4,12,650 and execution expenses of Rs 5000 is imposed on the complaint. There is no written mention of demolition of the mosque anywhere in this order. After this order, a team from the tehsil visited the village and also saw the geographical location of the mosque.

Complaint was lodged in HC regarding occupation of three ponds Actually, this whole controversy started from the year 2019. Gulshar’s house is about 500 meters away from the mosque. On his complaint, the Tehsil Court ordered the eviction of the mosque considering it an illegal construction. To understand the whole issue, we first reached Gulshar’s house. Gulshar, disabled from both legs, was found sitting on the bed in the room outside the house.

Gulshar says- I am a social worker. I came to know that there used to be three ponds in our village. Later all three ponds came under illegal occupation. A mosque and 6 houses have been built on Khasra No. 603, more than 30 houses have been built on Khasra No. 617. The crop is standing on Khasra number- 636. These three Khasra numbers are in the name of the pond in the government documents.

I first sent a complaint to Baghpat DM in 2019. He got the investigation done by the then accountant Vinod Verma. During investigation, the accountant told that only a mosque has been built on the land of the pond, nothing else. I filed an objection to this investigation report with the Meerut Commissioner in 2020. From there again investigation was ordered. In the second investigation also the accountant submitted the same report as before. After this, in 2022 I went to the Chief Minister’s Office, Lucknow.

As no action was taken at the administrative level, I filed a petition directly in the Allahabad High Court on July 15, 2024. Just 14 days later, on July 29, 2024, the High Court ordered the Baghpat Tehsil Court to dispose of the case within 90 days. Exactly within a month, i.e. on October 28, 2024, the Baghpat Tehsil Court found the mosque to be an illegal construction and ordered it to be vacated.

I had complained to the High Court about illegal encroachment on a total of three ponds. The High Court had ordered to dispose of the entire complaint. Despite this, the Tehsil Court has given verdict on the illegal construction of only one pond.

Tortured me in many other ways. Because of this my mobile repairing business stopped. Showing a dilapidated shop counter in a corner of the house, Gulshar says – I want all three ponds of the village to be like before.

The elder said – the one who is complaining is trapped in a rape case. From here we directly reached the mosque about which there is a complete controversy. A path leads to the government school on the outer edge of the village. A mosque is built on this road. Next to the mosque, about 5-6 houses are built on both sides. It was 12:30 in the afternoon. The mosque was locked. It came to light that Fariyad comes only in the morning and evening to offer Namaz. Here we talked to the local elders and wanted to understand the reality of constructing a mosque on the pond land.

The young man who is complaining about the mosque has already been involved in a rape case. The family which had filed the case lives near the mosque. The complainant wants that if a settlement is reached in the rape case, he will withdraw the complaint about illegal construction of mosque and houses.

Elder Sheeda of the village says – It has been 70 years since we started seeing this mosque. Only one person has complained that a mosque has been built on the pond land. Apart from him, no one else in the entire village is saying this. That person is against the entire village. He just wants money.

‘We will not let the mosque be demolished like this’ Sanjeev, who lives in the same locality, says – The mosque was built 70-75 years ago. We have been considering it a mosque since the beginning. There is nothing like a pond here. The complainant is demanding money and blackmailing. We will not allow the mosque to be demolished like this. If this happens then the entire locality will be destroyed.

‘Only one person tells about the pond, no one else’ After talking to the local youth, we reached the house of village head Ram Sevak. 80 year old Ramsevak was found sitting on a cot outside the house. He was not ready to talk on camera. 65 year old Ramphal was sitting near him.

He said – We have never seen a pond on that land till date. Even our elders never told us about a pond. Our village is peaceful. There was never any fight here. Only one person, Gulshar, says that there used to be a pond on that land. No one else is saying this except him.

Some other youth present here, on the condition of anonymity, told off camera – a case of rape was registered against Gulshar many years ago. Because of this he harbors a grudge against the mosque and the entire locality. Due to this, he has made this complaint, so that he can put pressure on him to compromise in the rape case registered against him.

Gulshar said- I was falsely implicated, it has nothing to do with the mosque incident. We again spoke to Gulshar to know the truth about the case. He told- In the year 2019, I had complained against the then head Satendra Chaudhary about the irregularities in the development works. The allegations were found true during investigation. DM ordered recovery of Rs 1 crore 28 lakh from the then head. In this, recovery of Rs 58 lakh was also done. The then principal party put a lot of pressure on me for a compromise in this case. He also came to my house with Rs 10 lakh, but I refused to compromise.

Gulshar told- I had lent 20 thousand rupees to a woman. The former head used that woman against me and filed an FIR against me for rape in Baraut police station at the end of 2021. This case is now going on trial in Baghpat Court. I am completely innocent in this case. I will present my case strongly in the court through a lawyer. It is completely wrong for the villagers to say that I am complaining about illegal construction for the sake of settlement in this case. This case has nothing to do with the mosque episode.

Lawyer said- filed objection against the court order At last we reached the house of Fariyad, the mutawalli (caretaker) of the mosque. His house is on the main road outside the village. He works in making furniture at home. Farid found us making furniture. The complainant refused to talk anything and gave the mobile number of his lawyer.

We spoke to the mosque side’s lawyer Dinesh Sharma over phone. The lawyer said- We have filed an objection in the DM court against the decision of the Tehsil Court. We will present our complete position there. This objection will be heard in the DM court on November 18.
