The court said that Sabita not only conducted the investigation again despite three investigation reports in favor of the petitioner, but also acted as an appellate officer contrary to the stay order of the High Court. She considered herself above the law. The next hearing of the petition will be on January 16.

This order was given by the division bench of Justice Shekhar B Saraf and Justice Kshitij Shailendra while hearing the petition of Amita Tiwari alias Neha Tiwari.

Earlier, the court had asked for a personal affidavit. If it was not followed, it was directed to appear and give an explanation. After this, he appeared and filed an affidavit.

A complaint of financial irregularities was made against the petitioner. In whose investigation the allegation was found baseless. On repeated complaint the investigation was in favor of the petitioner twice. The court banned the investigation. Even after this the inquiry was again set up. The court termed it as misuse of law and ordered disciplinary inquiry proceedings against Joint Development Commissioner NB Sabita and asked the Chief Standing Counsel to submit the report of the action taken on the next date.
