Association for Protection of Civil Rights (APCR) organization has filed a PIL in this matter. The petitioners say that the administration has violated the fundamental rights of the people by taking action in the name of illegal construction after the violence.

The incident occurred on October 13, when communal violence broke out during idol immersion in Maharajganj market of Mahsi tehsil of Bahraich district. During the violence, a youth named Ram Gopal Mishra was shot dead. After this, tension spread in the area and many shops, houses and vehicles were set on fire.

After the incident, the administration took action against the main accused Abdul Hameed and 23 other persons. Demolition notices were issued accusing them of illegal construction on government land.
