Supreme Court judge Justice KV Viswanathan on Tuesday recounted an unpleasant experience on a flight where he was accompanied by another SC judge, Justice Surya Kant. Two drunk passengers were on the same flight as the two judges.

Justice Viswanathan narrated the event during a hearing seeking measures to deal with unruly flyers. The judges were hearing the case of a 73-year-old elderly woman who alleged that a drunk passenger had urinated on her on an Air India flight in 2022.

“We had a recent experience during air travel. Two male passengers were fully drunk. One went to the washroom and slept off. The other one, who was outside and had a bag to vomit. The crew was all women. For 30 to 35 minutes, no one could open the door,” said Justice Viswanathan.

The crew then requested a male passenger to open the door and take him out of the seat, the judge said, causing significant distress to the crew and passengers. A bench led by Justices BR Gavai and KV Viswanathan questioned the Centre how it checks passengers who get intoxicated in-flight.

Justice Viswanathan told Additional Solicitor General Aishwarya Bhati that authorities should find a “creative” solution to address the issue of unruly air passengers and a strategic seating plan for flyers was required to be put in place.

Meanwhile, the elderly woman’s petitioner said guidelines only deal with the aftermath of possible incidents, but not with what crew members are supposed to do when faced with such situations, particularly in the case of senior citizens.
