A FIR was lodged on 7 March 2023 against Ashraf, Saddam, Lal Gaddi, Dayaram and other constables Shivhari Awasthi and some other unknown jail officers and employees at Bitari Chainpur police station in Bareilly. It is alleged that these people have committed the crime of illegally meeting the jailed mafia Ashraf people. These people used to get seven, eight people to meet Ashraf on the same ID. Many serious cases were pending against Ashraf in various courts.

The petitioner’s advocate argued that he has been falsely implicated in this case. There is no other evidence against him except the telephone conversation. The reality is that at the time of the incident being narrated, he was in Allahabad and Lucknow for the treatment of his mother and had gone to Delhi to meet his brother. He has given evidence of this. He has been implicated in this case because he is a relative of Ashraf. Whereas the bail of other accused in this case has been approved. The petitioner is in jail since 28 August 2023.

Opposing the bail application, Additional Advocate General Manish Goyal said that there are serious allegations against the petitioner. SIT was formed to investigate. He was found actively involved in the entire incident. He is a close relative of Ashraf. He did not even pay the rent for the house in which the petitioner lived in Bareilly. Mobile call details have revealed that he has talked to co-accused hundreds of times and evidence of money transactions to provide illegal facilities in the jail has also come to light.

After considering all the aspects, the court said that there is only evidence against the petitioner regarding telephone conversation. The investigation of this case has been completed and the charge sheet has been filed in the court. The court approved Saddam’s bail considering all the circumstances and evidence.
