Allahabad High Court has asked the state government whether professors and heads of departments of government medical colleges can do private practice in private nursing homes? The court has written to the government lawyer and Principal Secretary Medical Education and Health, Uttar Pradesh Lucknow in this regard.

The court has also directed the state government to investigate whether government doctors appointed in state medical colleges are providing treatment in private nursing homes or medicine shops.

This order has been given by the single bench of Justice Rohit Ranjan Aggarwal while hearing the petition of Professor Dr. Arvind Gupta, Head of the Department of Nephrology at Motilal Nehru Medical College.

It is known that Rupesh Chandra Srivastava has filed a complaint against the petitioner in the District Consumer Forum and demanded compensation. They say that the petitioner, a professor at the medical college, received wrong treatment at the private Phoenix hospital.

Dr. Gupta filed a petition objecting that the District Consumer Forum has not given any order. Despite this, a case was directly filed against him in the State Consumer Commission, which is not maintainable. Also, the dispute is only about Rs 1890. Such small cases cannot be taken to the State Consumer Commission.

On the objection of the petitioner, the court said that the basic question is whether a government doctor can provide treatment in a private hospital or not. How the petitioner, being a medical college professor, treated the patient in a private hospital in Phoenix, the court took this seriously and ordered an inquiry into the treatment done by government doctors in private hospitals.

Rupesh Chandra Srivastava had admitted his wife Ekta to Phoenix Nursing Home in Prayagraj for treatment. The complainant alleges that the nursing home called Dr. Arvind Gupta for treatment and also charged fees, but the treatment was wrong. The couple filed a claim with the State Consumer Commission for justice.
