In a ruling last November, the Supreme Court stated that the Enforcement Directorate must obtain prior sanction before prosecuting public servants.

Financial probe agency Enforcement Directorate (ED) has received approval from the Ministry of Home Affairs (MHA) to prosecute Aam Aadmi Party (AAP) chief Arvind Kejriwal in the money laundering case linked to the now-scrapped Delhi excise policy.

The Ministry’s decision follows Delhi Lt Governor VK Saxena’s approval to prosecute the former Delhi Chief Minister in the case.

In a ruling last November, the Supreme Court stated that the Enforcement Directorate must obtain prior sanction before prosecuting public servants.

The next month, the investigation agency sent a letter to the Lt Governor, arguing that sanction should be granted as Kejriwal is the “kingpin and key conspirator” in the scam.

In response, the AAP chief approached the Delhi High Court, claiming that the chargesheet filed by the probe agency against him and others is illegal, as no prior sanction from the authorities was obtained before submitting the prosecution complaint.
