The Lucknow bench of Allahabad High Court has refused to stay the demolition of illegal construction at Teele Wali Masjid. The petitioner had continuously talked about expansion and demanded a stay. The court said that we cannot give any order.

The petitioner has presented the order of the Archaeological Survey of India (ASI) before the court and has demanded the removal of this illegal construction.

After hearing the petition, the court has ordered the ASI and the state government as well as the District Magistrate of Lucknow to file a counter affidavit. The court has also made it clear in its order that the current petition being pending in the court will not have any effect on the ASI’s order regarding the removal of illegal construction.
This order has been passed by the division bench of Justice Rajan Roy and Justice Om Prakash Shukla after hearing the PIL filed by Rishi Kumar Trivedi and others. During the hearing, advocate Hari Shankar Jain, appearing on behalf of the petitioners, told the court that on 20 September 2016, the ASI had passed an order for demolition of the said illegal construction, which was not complied with.
After this, ASI again issued an order on 6 December 2023, although it has not been complied with yet. Through the petition, a demand has been made to the court to comply with the order of ASI.
At the same time, the advocate appearing on behalf of the state government told the court that the responsibility of complying with the order of ASI lies with the District Magistrate, Lucknow, however, no instructions have been received in this regard. On this, the court ordered the opposing parties to file a counter affidavit and also ordered the ASI to provide evidence related to the service of notice to Maulana Fazlul Mannan Rahmani of the mosque.
