The Lucknow bench of Allahabad High Court has stayed the suspension of Dr. Ashwani Kumar Singh, Registrar of Baba Saheb Bhimrao Ambedkar University. The court has also stayed the investigation against the registrar. Also, the Central Government and the University must respond within four weeks.

A single bench of Justice Abdul Moin gave this order on Thursday on the petition of Dr. Ashwani Kumar Singh. Dr. Ashwani had challenged the order of suspension on 18 November and the order of departmental inquiry on 22 November. Both the orders were passed by the acting Vice Chancellor. Dr. Ashwani argues that under the rules, passing this order against him does not come under the jurisdiction of the Vice Chancellor.
Opposing this petition, the university argued that the Vice Chancellor has the right to take action against the employees of the university. This action has been taken against Dr. Ashwani after a case of corruption was found.
After hearing the arguments of both the parties, the court said that under the provisions of the rules of the university, employees and officers have been defined separately and the Registrar has been considered as an officer.
The court said that the Vice Chancellor can take action only against the employees and cannot take any action against the officers. Therefore, it appears that the Vice Chancellor has given both the orders beyond his authority, which is wrong.
