The Defence Ministry recently responded to relevant questions in the Lok Sabha about the medical pension of Army personnel who have been deemed unfit for duty by the Army Medical Board due to physical and mental disabilities.

In the Lok Sabha, parliamentarian Hanuman Beniwal questioned the defence ministry about the actions taken or planned in relation to the medical pension of army personnel who have been deemed unfit for duty due to a handicap. The MP also asked about measures taken to guarantee impartiality and openness in evaluations of disabilities.

“The government has issued the Entitlement Rules for Casualty Pensionary Awards to the Armed Forces Personnel – 2023 and Guide Medical Officers – 2023 to harmonise the Defence Disability Pension Regulations with the regulations for civilian employees issued by the Ministry of Personnel, Public Grievances and Pensions on time to time and also to ensure that Medical Boards are conducted optimally and uniformly,” said Minister of State in the Defence Ministry Sanjay Seth as quoted by Financial Express.

According to the minister, the government offers the following pensions to army personnel who have been deemed unfit for duty by the Army Medical Board due to physical and mental disabilities: Terminal Gratuity to Officer Invalidated Out of Service, War Injury Pension, Disability Pension, and Invalid Pension/Invalid Gratuity.

The minister clarified that the Medical Board has three members in accordance with the Armed Forces’ RMSAF-2010 regulations to guarantee objective assessments in response to the query regarding guaranteeing justice and openness in disability assessments. Additionally, DGMS (Army) reviews all Psychiatric Board reports for officers, and MG (Med) reviews them for junior commissioned officers and other ranks to make sure they are clear and error-free.

Furthermore, the number of Indian Army members who have been deemed unsuitable for duty due to physical and mental disabilities and have not yet received pensionary benefits, as well as suggestions for pension provisions for these soldiers, were two other questions.

In response, the minister stated that army personnel who are deemed unfit for duty by the Army Medical Board due to a disability receive disability pensions under the Entitlement Rule (ER) 2023, the Pension Regulations for Army (PRA) 2008, and other current regulations.
