The Lucknow bench of the Allahabad High Court has asked the Lucknow Municipal Corporation on its petition challenging the show cause notice in the case of the eviction of the government bungalow at River Bank Colony of Nikhat Aflak, sister of former cabinet minister Azam Khan. The court directed Municipal Corporation lawyer Namit Sharma to hand over the documents to Aflak’s lawyer on the basis of which he has been given a show cause notice. The next hearing of the case will be on Tuesday.

The order was passed by a bench of Justice Pankaj Mittal and Justice Saurabh Lavania on the plea of ​​Nikhat Aflak. The petition stated that a show cause notice was sent to the petitioner on August 24, 2020 regarding eviction of A-2/1, River Bank Colony Bungalow. It has been said that the show cause notice has not been given to them on the basis they are being told to vacate the bungalow.

Wrong to say the basis of eviction of the bungalow

Senior advocate HGS Parihar of the petitioner argued that two grounds have been given to vacate the bungalow. The first petitioner does not reside in the said bungalow but resides in Rampur district and the second according to the policy of 9 February 1951, the said bungalow can be allotted only to government officials. The advocate said that a show cause notice has not been issued to the other grounds of vacating the bungalow, ie, the basis of allotment for government officials.
