- Congress worker filed petition before the Chairman of the Legislative Council
The Executive Chairman of the Legislative Council has given a decision on the petition by the Congress worker for termination of membership under the defection law of MLC Dinesh Pratap Singh from Rae Bareli area. Executive Chairman Kunwar Manvendra Singh has given the final decision on the merger of Congress MLC Dinesh Pratap Singh with the BJP party.
Dinesh Pratap Singh MLC was elected as the candidate of the Indian National Congress from March 2016 from the Legislative Council area of Rae Bareli. On the matter, Congress MLC Deepak Singh said that, the party will challenge the decision of the Chairman in the High Court.
The Chairman said that the change of party law should not be implemented when Congress has only two MLCs
Legislative Council Chairman Kunwar Manvendra Singh has ruled on disqualification of petitioner’s membership of MLC Dinesh Pratap Singh. In the order given by the Chairman, it was mentioned that the petitioner, Devansh Tiwari was cited by the Congress workers under Rule 1987 on the basis of change of party.
But after hearing both sides of the petitioner and MLC Dinesh Pratap Singh or it became clear that only Deepak Singh Member and Dinesh Pratap Singh from Congress are the Legislative Council Member. In such a situation, the membership of Bharatiya Janata Party has been voluntarily accepted by Dinesh Pratap Singh. Therefore the defection law does not apply to it. Membership cannot be terminated with 50 per cent coming from two MLCs.
On 4 August 2020, the Congress worker filed the petition
Congress activist Devansh Tiwari filed a petition before the Speaker’s Legislative Council on 4 August 2020 asking for the cancellation of MLC Dinesh Pratap Singh’s membership. It was argued by the petitioner that Dinesh Pratap Singh has taken membership of BJP.
It was subscribed by Dinesh Pratap Singh on 21 April 2018 in the presence of the then BJP National President Amit Shah and the Chief Minister of the state Yogi Adityanath. On this basis, the membership of the Legislative Council under Dinesh Pratap Singh should be canceled.
