In a unanimous verdict, the Supreme Court on Thursday ruled that the Delhi government has legislative and executive powers over services.

Hearing the Centre versus the Delhi government over the issue of demarcation of power, a constitution bench headed by Chief Justice DY Chandrachud said an elected government needs to have control over the administration.

It refused to agree with the 2019 judgement of Justice Ashok Bhushan that the city government has no power over the issue of services.

The Delhi government has control over administrative services, the Supreme Court has said. Only services under Public Order, Police and Land are excluded from the purview of the Delhi government.

If the officers stop reporting to the ministers or do not abide by their directions, the principle of collective responsibility is affected, Supreme Court said.

Ensure Governance Of States Is Not Taken Over By Union: Supreme Court

It is not a State under first schedule yet it is empowered to legislate.Union has power and state too has the power but the executive power of the state will be subject to the law existing of the union. How The Tussle Between Delhi Lt Governor And AAP Government Began

The case has its roots in 2018, when the Arvind Kejriwal government had gone to court, arguing that its decisions were constantly being over-ridden by the Lieutenant Governor, who acts as the Centre’s representative in Delhi.

Bureaucrats’ appointments were cancelled, files were not cleared, and basic decision-making was obstructed, the Delhi government had told the court.

In a landmark verdict next year, the top court said the elected government of Delhi is the boss.
