While hearing a PIL on Tuesday, the court said that despite the previous order, the Secretary of Basic Education and Social Welfare Department did not give the affidavit.

This order was given by the division bench of Justice Rajan Roy and Justice Om Prakash Shukla after hearing the PIL filed by the UP Scheduled Caste Primary School Teachers Association. During the hearing, the court found that on April 3 itself, the court had asked the principal secretaries of basic education and social welfare to file counter affidavits in the court.
Even after this order of the court, the affidavit has not been filed by them in the court, on which the court has asked both the officers to appear and explain why the previous order was not complied with. Along with this, the court has also said that if they had filed the affidavit in the court by then, then there would be no need for them to appear in the court.
Through the petition, the petitioner has told the court that in the schools run by Basic Education, uniforms are given to the children of classes one to eight, whereas through the office memorandum dated 26 October 2023, the facility of uniforms is not being provided to the children of the schools of the Social Welfare Department. has been denied.
At the time of its last hearing, the court had said that the order stopping the facility of uniform does not appear to be justified on the face of it.
