MP-MLA Court Special Judge PK Rai reserved his verdict after completing the hearing against former Congress MLA Sanjay Pratap Jaiswal. He is facing a case of raping a girl by luring her with a job.

According to the prosecution, the FIR in this case was lodged by the victim at the Hazratganj police station. It was said that she had come to Lucknow in October 2012 to prepare for the competitive examination. Then he met Sanjay Pratap Jaiswal, Amarjit Mishra and another in the waiting room of Charbagh railway station.

It is alleged that Sanjay Jaiswal, who described himself as a doctor, took all his papers on the pretext of getting him a job. After this, he was called to Lara Hotel in Varanasi on the pretext of getting the papers signed. There, after feeding her intoxicants, raped her and made a video. Earlier, public prosecutor SN Rai completed his arguments on behalf of the prosecution.

# Justice is not likely to fail due to the head constable’s deliberation, so the hearing cannot be canceled

The Lucknow Bench of the Allahabad High Court said that the hearing before the trial court is not affected by the deliberation of the non-competent Investigating Officer. However, the court said that the investigation should be done by a competent police officer only. The decision was passed by a single bench of Justice Rajesh Singh Chauhan on the petition of Nitesh Kumar Verma.

It was said in the petition that the NCR victim lodged a complaint of assault and abuse against him and others. Later, on the orders of the magistrate, the investigation of the case started. On the basis of the statements of the victim and other witnesses, the sections were increased when the offense of attempt to rape came to light. Then the charge sheet was filed.

It was argued on behalf of the petitioner that the police officer who had done the said investigation. He was in the rank of Head Constable. It was said that under a 1997 mandate of the state government, the head constable cannot investigate such a serious matter.

The Court said that the cognizance and trial cannot be set aside unless it is satisfied that the investigation conducted by a non-competent police officer is likely to lead to failure of justice.

# Lucknow’s lawyers raised the demand to increase the jurisdiction

The Avadh Bar Association of Lucknow Bench has demanded to increase the jurisdiction on the basis of the report of Jaswant Singh Commission. In this, it was recommended to connect Bareilly and Moradabad divisions with Lucknow Bench. Apart from this, a demand has also been made to connect Kanpur, Basti, Azamgarh and Gerakhpur divisions with Lucknow.

An emergency meeting of the bar was held on Tuesday under the chairmanship of Chairman Rakesh Chaudhary. General Secretary Amarendra Nath Tripathi said that it has been decided that a delegation of senior advocates will meet Union Defense Minister Rajnath Singh and Union Law Minister Kiren Rijiju soon in support of their demands. The delegation will demand that keeping in view the capacity of Lucknow Bench and its proximity to the capital of all the districts, work should be done to increase the jurisdiction of Agra Bench before making it.
