Along with staying this order of the Executive Council, the court has asked LU to file a counter affidavit. The court has fixed October 1 as the date for the next hearing of the case. This order has been passed by a single bench of Justice Manish Mathur after hearing the service related petition of Prof. Monisha Banerjee.

The petitioner was not even given a full opportunity to be heard before the order. The petitioner told the court that the petitioner had complained of harassment against the director of the institute.

During the hearing, the petitioner also told the court that even a charge sheet was not issued against the petitioner.

Adequate opportunity was given to be heard Opposing the petition, the counsel appearing for LU told the court that the petitioner was given ample opportunity to be heard. However, the court, prima facie finding the arguments made on behalf of the petitioner correct, stayed the order dated 9 August 2024.
