The Allahabad High Court has termed as illegal the unnecessary keeping of a girl who had a love marriage in a Children’s Home (Girls), Ballia for two years and nine months and said that the victim is free to take action as per the rules against this illegal detention. This order was given by Justice Arvind Singh

The girl from Ballia was living in Hyderabad with her husband after love marriage. The family lodged an FIR against her husband on kidnapping charges. The police recovered the girl and presented her before the Child Welfare Committee. Since then she was confined in the Children’s Home (Girls), Ballia. On October 3, the court had asked the chairman of the Child Welfare Committee, Mau, why the girl was kept in a children’s home for two years and 9 months. On this, the Chairman filed an affidavit stating that the prisoner was a minor. She was not ready to go with her parents. The parents also did not want to take delivery against his wishes. However, now he has been freed. On this, the court did not consider the explanation satisfactory and said that it is illegal to keep the girl in custody without any reason in the Children’s Home (Girls), Ballia for two years and nine months. For this the girl is free to take action as per rules.
